A Foreign Investment Promotion and Protection Agreement (FIPA) is a bilateral agreement aimed at protecting and promoting foreign investment through legally-binding rights and obligations. FIPAs accomplish their objectives by setting out the respective rights and obligations of the countries that are signatories to the treaty with respect to the treatment of foreign investment. Typically, there are agreed exceptions to the obligations. FIPAs seek to ensure that foreign investors will not be treated worse than similarly situated domestic investors or other foreign investors; they will not have their investments expropriated without prompt and adequate compensation; and, in any case, they will not be subject to treatment lower than the minimum standard established in customary international law. Un Accord sur la promotion et la protection des investissements étrangers (APIE) est un accord bilatéral visant à protéger et à promouvoir l'investissement étranger par des droits et des obligations juridiquement contraignants. Un APIE atteint ses objectifs en énonçant les droits et obligations de chacun des pays signataires quant au traitement de l'investissement étranger. En général, l'APIE contient des exceptions convenues aux obligations. L'APIE assure aux investisseurs étrangers qu'ils recevront un traitement aussi favorable que leurs homologues nationaux ou les investisseurs d'autres pays; que leurs investissements ne seront pas expropriés sans que des indemnités suffisantes ne leur soient versées promptement; et qu'ils ne seront en aucun cas soumis à un traitement inférieur à la norme minimale prévue dans les règles du droit international coutumier.
